The Sweepstakes begins at 12:01 a.m. EDT on June 11, 2023, and ends at 11:59 p.m. EDT on June 14, 2023 (“Sweepstakes Period”).
ELIGIBILITY: This Sweepstakes is open only to legal residents of the United States and the District of Columbia (“U.S.”) who are at least 18 years of age or older at the time of entry. Employees of Paycom Payroll, LLC (“Sponsor”) and any of its affiliates and subsidiaries, as well as the immediate family (spouse, parents, in-laws, siblings and children) and household members of each such employee, employees of a competitor of Sponsor in the payroll and human capital management industry and/or employees of another vendor at SHRM 2023 are not eligible. Void where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state and local laws and regulations.
AGREEMENT TO THE OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: No purchase necessary. All entries become the property of Sponsor and will not be returned. All winners must meet the eligibility requirements set forth in these rules to qualify for the prize. Entries are earned by scanning attendees’ conference badges or by completing an entry form online at paycom.com/SHRM-Spa. In the event of a dispute, entries will be deemed made by the person whose legal name appears on the entry form. Submissions are limited to one per person during the Sweepstakes Period. Sponsor is not liable for lost, late or misdirected entries.
WINNER SELECTION: There will be one (1) winner. A tie is not possible. The winner will be selected in a random drawing on Monday, June 19, 2023, at 11 a.m. EDT from among all eligible entries received. Winner will be notified by telephone and/or email, and then the winner’s name will be posted to Twitter. If a potential winner cannot be contacted within one week of the first attempt to contact him/her or the winner is unavailable for chosen prize dates, such potential winner forfeits prize and an alternate entrant will be selected in his/her place in a random drawing from among all remaining eligible entries.
PRIZE: The winner will receive a three-day, two-night all-inclusive trip to Miraval Arizona. The resort prize package includes airfare and ground shuttle transportation; room accommodations; all meals, snacks and non-alcoholic beverages; $175 nightly resort credit applicable to spa services, fee-based activities or private sessions; an arrival gift; access to resort and spa amenities; and gratuities. The package does not automatically include specific spa services. Trip dates are subject to availability. Prize is nontransferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Prize is provided “as-is” and without warranty, express or implied, of any kind. Odds of winning a prize depend on the number of eligible entries received during the giveaway period.
PUBLICITY: By entering the Sweepstakes and/or accepting prizes, each entrant grants Sponsor (and its licensees and partners) a nonexclusive, worldwide, royalty-free, perpetual license to edit, publish, promote, republish at any time in the future and otherwise use entrant’s submission and any other information or materials provided by entrant in any and all media now known or hereinafter devised, without territorial restriction (except where prohibited by law) for possible editorial, publicity, promotional or advertising purposes, without further permission, notice or compensation (except where prohibited by law). All submissions, including submission file and content, will become property of Sponsor and may be used by Sponsor for commercial purposes without payment of any kind to the participating entrants.
GENERAL CONDITIONS: Sponsor reserves the right, in its sole discretion, to modify, suspend or cancel the Sweepstakes and select winner(s) from the entries received prior to the modification, suspension or cancellation. Sponsor agrees to take such action in a fair and appropriate manner. In addition, Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the submission process or the operation of the Sweepstakes or to be acting in violation of these Official Rules. By entering the Sweepstakes, each entrant is obligated to provide Sponsor with any and all personal financial or tax information deemed necessary by the Sponsor to complete the transfer of ownership of the all-inclusive trip or the substituted prize, including but not limited to a W-9 form and a Transfer of Ownership. LIMITATION OF LIABILITY: BY RECIEPT OF ANY PRIZE, WINNER AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ADMINISTRATOR AND ANY PROMOTIONAL PARTNERS OF EACH OF THEIR PARENT, SUBSIDIARY, AFFILIATE AND RELATED COMPANIES AND EACH OF ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY THE “RELEASED PARTIES”) FROM AND AGAINST ANY LOSSES, DAMAGES, RIGHTS, CLAIM OR CAUSE OF ACTION OF ANY KIND ARISING, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, OUT OF PARTICIPATION IN THE PROMOTION OR RESULTING DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE AWARDED IN CONNECTION WITH THE PROMOTION, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH AND/OR PROPERTY DAMAGE, AS WELL AS CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION AND/OR INVASION OF PRIVACY. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) unauthorized human intervention in any part of the entry process; (3) technical or human error which may occur in the administration of the Sweepstakes or the processing of Sweepstakes submissions, including, but not limited to, malfunctions or disconnections in phone lines or network hardware or software; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize. Winners also acknowledge that the Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law relative to any prize or this Sweepstakes including, but not limited to, quality, condition or fitness for a particular purpose. If for any reason an entrant’s submission is confirmed to have been erroneously lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another submission and thereby another entry into the Sweepstakes.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants and Sponsor in connection with this Sweepstakes shall be governed by and construed in accordance with the substantive laws of the State of Oklahoma, without regard to any conflict of laws’ principles.
